Terms of warranty

EXCERPT FROM THE WARRANTY TERMS

Any defect covered by the warranty must be reported to “MERCOR” Light&Vent sp. z o.o. immediately and confirmed in writing within 7 days from the moment it is discovered.

A notification may be submitted by sending a completed WARRANTY FORM available at mercor.com.pl, by calling 058/341 42 45, by fax at 058/341 39 85, by email to reklamacje@mercor.com.pl, or by sending a letter to: “MERCOR” Light&Vent sp. z o.o., 80-408 Gdańsk, Grzegorza z Sanoka 2.

If physical defects occur during the warranty period, “MERCOR” Light&Vent sp. z o.o. undertakes to remove them within no more than 21 days from the date of receiving the written notification and proof of purchase or agreement, subject to item 6.

“MERCOR” Light&Vent sp. z o.o. reserves the right to extend the repair time in the case of complex repairs or those requiring the purchase of non-standard components or spare parts.

Warranty liability covers only defects arising from causes inherent in the sold devices.

The warranty does not cover:

• damage or malfunctions caused by improper use, user interference, lack of periodic technical inspections, or failure to perform maintenance activities;
• damage resulting from causes other than those attributable to “MERCOR” Light&Vent sp. z o.o., in particular from random events such as torrential rain, flooding, hurricane (wind ≥17.5 m/s), water damage, lightning strike, power surges, explosion, hail, etc.;
• damage resulting from failure to report a discovered defect without delay; deterioration of coating quality caused by natural ageing processes (fading, oxidation);
• defects caused by the use of abrasive or aggressive cleaning agents;
• parts subject to natural wear during operation (e.g. seals), unless a manufacturing defect is present;
• damage caused by aggressive external factors, particularly chemical or biological, or resulting from production processes or activities carried out within or near the facility where the devices were installed;
• contamination of polycarbonate chambers by dust or particles with an effective grain diameter below 50 μm;
• condensation of water vapour inside polycarbonate chambers during operation.

The Buyer / warranty holder is obliged to properly operate the devices and perform periodic technical inspections and maintenance activities in accordance with the rules described in the Technical and Operating Documentation of the devices.

The warranty expires with immediate effect if:

• the Buyer / warranty holder makes structural modifications on their own without prior approval from “MERCOR” Light&Vent sp. z o.o.;
• periodic inspections and maintenance activities were not performed on time, or were carried out by unauthorised persons or a company not holding valid authorisation to service “MERCOR” Light&Vent sp. z o.o., or if the devices were improperly operated;
• any unauthorised person interferes with the devices – except for activities falling within the scope of normal operation.

In the cases specified in item 8, the liability of “MERCOR” Light&Vent sp. z o.o. under statutory warranty is also excluded.
